Terms and Conditions
1. 5% VAT will be extra.
2. Loading and offloading time will be 3 hours for both sides, exceeding time will be charged on a pro-rata basis.
3. Accommodation and transportation for the operator and fuel for the machine shall be provided by the hirer.
4. If the equipment breaks down or needs service inside the site, the hirer shall arrange the pass for the mechanic or arrange for the machinery to move outside for service.
5. During the work, the operator will follow instructions from the supervisor, foreman, and flagman. In case of any damages on the ground like cables or other, we are not responsible for that.
6. If the equipment Tyres get punctured, the hirer has to repair them.
7. Our offer is based on the equipment working 10 hours a day, 6 days a week, and 260 hours a month, excluding weekly holidays and public holidays.
8. In case the equipment works for less than a month, the weekly rate will be applicable. If it isn't completed in a week, a daily rate will be applicable.
9. During the month of Ramadan, the working hours will be 8 hours/day.
10. The hirer shall take full responsibility and ownership of the prevailing conditions at the job site covering critical items like underground cables, water/gas pipelines, utility supply lines, hazardous elements, etc., and shall provide clear communication and necessary guidance to operators.
11. All government-related taxes/duties, including company taxes, withholding taxes, duties, and custom deposits/guarantees, and any other levies arising due to the operation of equipment on-site or by way of traveling to the site, are to be borne by the hirer.
12. MGT equipment will be mobilized to the site at the client's responsibility. Site inspections will not be conducted by MGT. If the equipment is returned without completing the job, MGT will not be liable for any direct or indirect losses, and the full rental charges will apply.
13. MGT is not liable for any direct or consequential losses or damages incurred by the customer, any other party, or property (including materials subject to the lift due to breakdowns, accidents, operator error, or other causes. The customer indemnifies MGT against such liabilities.
14. In cases of inclement weather, such as high wind, sandstorms, fog, rain, or other force majeure events, which prevent the equipment from operating, the affected period will be considered part of the normal working time. Delays beyond MGT's control will be charged on a pro-rata basis.
15. While on-site, the operator will be under the direct control and supervision of the customer, who will be responsible for all acts or omissions of the operator while carrying out work based on the customer's directions.
16. The customer must not request the equipment to perform lifts exceeding its rated capacity.
17. MGT's equipment and personnel are insured; however, insurance coverage for materials handled by the equipment is not included in the scope of work. The client is responsible for securing such insurance and waiving subrogation rights against MGT for any liabilities.
18. The customer is responsible for arranging the necessary permissions for MGT's equipment and personnel to operate at the job site.

4. إذا تعطلت المعدات أو احتاجت إلى صيانة داخل الموقع، يجب على المستأجر ترتيب تصريح للميكانيكي أو ترتيب نقل الآلات إلى الخارج للصيانة.
5. أثناء العمل، سيتّبع المشغل تعليمات المشرف ورئيس العمال وموجّه الإشارات، وفي حالة حدوث أي أضرار على الأرض مثل الكابلات أو غيرها، نحن غير مسؤولين عن ذلك.
6. إذا تعرضت إطارات المعدات للثقب، يجب على المستأجر إصلاحها.
7. عرضنا يعتمد على عمل المعدات 10 ساعات يومياً، 6 أيام في الأسبوع، و260 ساعة في الشهر، باستثناء العطلات الأسبوعية والعطلات الرسمية.
8. في حالة عمل المعدات لمدة أقل من شهر، سيتم تطبيق السعر الأسبوعي، وإذا لم يكتمل العمل في أسبوع، سيتم تطبيق السعر اليومي.
9. خلال شهر رمضان، ستكون ساعات العمل 8 ساعات يومياً.
10. يتحمل المستأجر المسؤولية الكاملة عن الظروف السائدة في موقع العمل بما في ذلك الكابلات تحت الأرض وخطوط أنابيب المياه/الغاز وخطوط إمداد المرافق والعناصر الخطرة، ويجب توفير التواصل الواضح والإرشادات اللازمة للمشغلين.
11. جميع الضرائب/الرسوم الحكومية، بما في ذلك ضرائب الشركة، والضرائب المقتطعة، والرسوم، وضمانات الودائع الجمركية، وأي رسوم أخرى تنشأ بسبب تشغيل المعدات في الموقع أو عن طريق السفر إلى الموقع، يتحملها المستأجر.
12. سيتم نقل معدات MGT إلى الموقع على مسؤولية العميل. لن تجري MGT عمليات تفتيش للموقع. إذا تم إرجاع المعدات دون إكمال العمل، لن تكون MGT مسؤولة عن أي خسائر مباشرة أو غير مباشرة، وسيتم تطبيق رسوم الإيجار الكاملة.
13. MGT غير مسؤولة عن أي خسائر أو أضرار مباشرة أو تبعية يتكبدها العميل أو أي طرف آخر أو الممتلكات (بما في ذلك المواد الخاضعة للرفع بسبب الأعطال، أو الحوادث، أو خطأ المشغل، أو أسباب أخرى. يعفي العميل MGT من هذه المسؤوليات.
14. في حالات الطقس السيئ، مثل الرياح العاتية، والعواصف الرملية، والضباب، والأمطار، أو غيرها من الأحداث القاهرة التي تمنع تشغيل المعدات، ستعتبر الفترة المتأثرة جزءًا من وقت العمل العادي. التأخيرات خارجة عن سيطرة MGT ستُحسب على أساس تناسبي.
15. أثناء وجوده في الموقع، سيكون المشغل تحت السيطرة المباشرة وإشراف العميل، الذي سيكون مسؤولاً عن جميع الأفعال أو الإغفالات للمشغل أثناء تنفيذ العمل بناءً على توجيهات العميل.
16. يجب على العميل ألا يطلب من المعدات أداء عمليات رفع تتجاوز سعتها المقدرة.
17. معدات وأفراد MGT مؤمن عليهم؛ ومع ذلك، لا يشمل التأمين تغطية المواد التي تتعامل معها المعدات ضمن نطاق العمل. العميل مسؤول عن تأمين هذا التأمين والتنازل عن حقوق التعويض ضد MGT لأي مسؤوليات.
18. العميل مسؤول عن ترتيب التصاريح اللازمة لمعدات وأفراد MGT للعمل في موقع العمل.
